ICSID Arbitration Rules

The ICSID Rules of Arbitration (hereinafter “ICSID Arbitration Rules”) have undergone a number of revisions since they were published in 1968, all of which may be found below.

The ICSID Arbitration Rules (1968-today)

The first version of the ICSID Rules of Arbitration was published in 1968, only two years after the ICSID Convention, and is available here: 1968 ICSID Arbitration Rules. The 1968 ICSID Arbitration Rules were scarcely used, and only nine cases were registered with the ICSID by the end of the 1970’s.

The second revision of the ICSID Arbitration Rules, which was published in 1984, is available here: 1984 ICSID Arbitration Rules. It was not until 1997 that the ICSID’s caseload exceeded ten registered cases per year, however.

ICSID Arbitration RulesAt the beginning of the new millennium, in the wake of dozens of new ICSID arbitrations being registered, the ICSID Rules were modernized. The third revision of the ICSID Arbiration Rules was published in 2003 and is available here: 2003 ICSID Arbitration Rules.

Soon afterwards, the current version of the ICSID Arbitration Rules was issued in 2006. The 2006 ICSID Arbitration Rules may be found here: 2006 ICSID Arbitration Rules.

Proposed amendments to the ICSID Arbitration Rules were published over the summer of 2018. These proposed amendments would constitute the most significant changes made to the ICSID Arbitration Rules since their creation, if adopted. In order to be adopted, 2/3 of the ICSID Member States need to approve the amendments. The proposed draft rules are available here.

ICSID Additional Facility Rules

The ICSID also proposes recourse through the ICSID Additional Facility, primarily for arbitrations involving a State which is not member to the ICSID Convention.

The first version of the Additional Facility ICSID Arbitration Rules was published in 1978 (available here: 1978 ICSID Additional Facility Arbitration Rules).

This was followed by the Additional Facility ICSID Arbitration Rules of 2003 (available here: 2003 ICSID Additional Facility Arbitration Rules).

The current version of the Additional Facility ICSID Arbitration Rules was issued in 2006 and remains in use. The latest version can be found here: 2006 Additional Facility ICSID Arbitration Rules.
