Aceris Law is pleased to announce another successful outcome, having represented a US-based distributor in a cross-border commercial dispute against an overseas supplier arising under an international vendor agreement providing for arbitration administered by the Hong Kong International Arbitration Centre (“HKIAC”).
The dispute concerned contractual indemnification issues relating to legal costs incurred in underlying products-liability-related litigation over an allegedly defective consumer product. Aceris Law assisted the client in advancing its contractual position and in pursuing recovery under the parties’ dispute resolution framework.
The case raised a number of issues frequently seen in international disputes: the interpretation of broad indemnity language, the recoverability of legal fees and costs, and the temporal scope of contractual provisions.
