Aceris Law is pleased to announce that its international arbitration lawyers have successfully won another international arbitration, this time representing a South Asian State organ. It worked with the Office of the Attorney General in prosecuting the matter.
The case concerned the breach of a sales agreement concerning the delivery of critical equipment needed to respond to the COVID-19 pandemic. Despite our client’s prompt payments and numerous attempts to amicably resolve the matter, the Respondent failed to supply the majority of the ordered equipment, entitling the Claimant to reimbursement of its overpaid amounts and to liquidated damages.
Aceris Law’s lawyers diligently invoked the appropriate legal bases in support of the client’s claims, including contractual entitlements, breach of contract, and unjust enrichment. Our client was awarded the totality of the amounts claimed (both the overpaid amounts and liquidated damages), as well as all arbitration costs.
The Respondent engaged in dilatory, abusive, and potentially fraudulent conduct, both before and during the arbitration, rendering this a well-deserved win for the client that puts an end to a long-standing dispute.
The arbitration was administered in an efficient manner by the Maldives International Arbitration Centre, which was established in 2013.
