投资者－东道国模式下的国际投资仲裁案件逐年增多，逐渐成为国际诉讼的重要组成部分。外国投资者常常使用该法律武器应对投资东道国不平等，甚至恶意地对待 。虽然使用该法律武器的成本极高，投资者平均需要支付五百万美元的仲裁费用和律师费用，但是在行内人俗称的纽约公约也就是1958年签署的《承认及执行外国仲裁裁决公约》和1965年签署的《关于解决国家与其他国家国民之间投资争端公约》，俗称华盛顿公约的保驾护航下，但凡国际仲裁庭裁定投资者胜诉并给予赔偿时，极大多数的东道国都会主动履行。所以该法律保护机制还是相当有效的。那么在国际投资仲裁中投资者的胜诉率如何呢。 许多的国际仲裁案件信息是机密的，根据某网站[1]上搜集到的案件信息情况来看（截止至写稿日2016年4月7日），裁判庭最终认定有利投资者的占26.4%而有利国家的则为36.4%，还有约十分之一的案件中途停止，大约四分之一的和解案件，最后的一小部分是中立判决，即虽然认定国家违背国际条约但是没有划给投资者任何赔偿。 具体来看投资者不同主张的胜诉率：投资者方共提出392起非法征收的主张（直接征收75起，间接征收317起），然而仅58起被仲裁庭承认（直接征收15起，间接征收43起），故而成功率仅为14.7%；关于违背公平与公正待遇的主张共有347起，而被仲裁庭承认的仅86件，故而成功率为24.7%；关于违背全面安全与保护的主张共有183起，而被仲裁庭认定的仅15起，故而成功率仅为8%；主张违背国民待遇的共有98起，而认定的仅8起，故而成功率也仅有8%；主张违背最惠国待遇的共有77起，而成功认定的仅有两件（笔者对该数据有一定的怀疑）。以上数据来自网络，笔者对其准确严谨性有所保留，仅为读者提供大致参考信息。 邓玉华, Aceris Law [1] http://investmentpolicyhub.unctad.org/ISDS/FilterByBreaches
