投资者-东道国模式下的国际投资仲裁案件逐年增多,逐渐成为国际诉讼的重要组成部分。外国投资者常常使用该法律武器应对投资东道国不平等,甚至恶意地对待 。虽然使用该法律武器的成本极高,投资者平均需要支付五百万美元的仲裁费用和律师费用,但是在行内人俗称的纽约公约也就是1958年签署的《承认及执行外国仲裁裁决公约》和1965年签署的《关于解决国家与其他国家国民之间投资争端公约》,俗称华盛顿公约的保驾护航下,但凡国际仲裁庭裁定投资者胜诉并给予赔偿时,极大多数的东道国都会主动履行。所以该法律保护机制还是相当有效的。那么在国际投资仲裁中投资者的胜诉率如何呢。 许多的国际仲裁案件信息是机密的,根据某网站[1]上搜集到的案件信息情况来看(截止至写稿日2016年4月7日),裁判庭最终认定有利投资者的占26.4%而有利国家的则为36.4%,还有约十分之一的案件中途停止,大约四分之一的和解案件,最后的一小部分是中立判决,即虽然认定国家违背国际条约但是没有划给投资者任何赔偿。 具体来看投资者不同主张的胜诉率:投资者方共提出392起非法征收的主张(直接征收75起,间接征收317起),然而仅58起被仲裁庭承认(直接征收15起,间接征收43起),故而成功率仅为14.7%;关于违背公平与公正待遇的主张共有347起,而被仲裁庭承认的仅86件,故而成功率为24.7%;关于违背全面安全与保护的主张共有183起,而被仲裁庭认定的仅15起,故而成功率仅为8%;主张违背国民待遇的共有98起,而认定的仅8起,故而成功率也仅有8%;主张违背最惠国待遇的共有77起,而成功认定的仅有两件(笔者对该数据有一定的怀疑)。以上数据来自网络,笔者对其准确严谨性有所保留,仅为读者提供大致参考信息。 邓玉华, Aceris Law [1] http://investmentpolicyhub.unctad.org/ISDS/FilterByBreaches
